Alternative Sentencing
Alternative sentencing is a term used to describe options offered to clients in lieu of incarceration. Sentencing is suspended while the individual works to comply with whatever the court alternatives might be. For example, the court may mandate, fines, probation, chemical dependency treatment, drug diversion classes, drug patches, alcohol bracelets or even house confinement.
The court can mandate them all be or can group them in specific combinations. We offer our clients assistance including pre-sentencing evaluation, court liaison, consultation to law firms, chemical dependency treatment, drug patches monitoring, alcohol bracelets monitoring and sober living.
Pre-Sentencing Evaluation, Support and Follow-Up
Pre-sentencing evaluation is often requested by attorneys and courts before legal action is taken. Facing the courts is highly stressful and anxiety producing. It is a time when a client needs to access all the supports possible. The likelihood of a positive outcome is enhanced through good planning.
First, we complete a thorough assessment to determine the extent of the clients difficulty with drugs or alcohol. All results are strictly confidential. Recommendations are made to professionals on a need-to-know basis. Information is released only on the client’s signature. Attorneys and Courts find assessment and recommendation extremely helpful in guiding the courts decisions. Second, we can also assist by providing clients with a Court Liaison who will be present for court appearances, assist with bracelets and patches. We provide assessment and recommendation as required. Third, we provide chemical dependency services before or after sentencing. We complete follow-up with attorneys and courts as necessary.
DUI Statistics
According to national data supplied by MADD, Mothers Against Drunk Drivers, in 2002 17,200 people were killed in crashes involving alcohol, representing a staggering 41% of the almost 43,000 people killed in all traffic crashes. Did you know?
- Binge drinkers accounted for 20% of the US population, but consumed 80% of the alcohol.
- 51% reported they did not drink for a month prior and 25% reported drinking once a week or less.
- A person died every 30 minutes in alcohol related crashes.
- Blood alcohol was highest for motorcyclists and lowest for large truck drivers, 29% and 1% respectively.
- 97% of US citizens see driving and drinking as a threat to personal safety.
- 3 in 10 Americans will be involved in alcohol related crashes in their lifetime.
- The highest prevalence for binge and heavy drinking was in 2000 in age groups between 18 and 25.
- The highest intoxication rates in fatal crashes in 2001 were recorded for drivers 21-24 years old (33%) followed by ages 25-34 (28%) and 35-44 (25%).
- Intoxication rates for males over .08 BAC was 24% and for females 13%.
With these types of statistics it is clear that driving under the influence has become pandemic in the US.
